Ticketing Terms & Conditions

Before proceeding with your purchase, please read these Terms and Conditions carefully. You must not complete your purchase unless you agree with these Terms and Conditions.

In compliance with the Health Orders of the State of Victoria released on 18 October 2021, all patrons must be fully Covid-vaccinated. Patrons must present proof of double-vaccination to obtain entry. The Terms and Conditions may be updated if these Health Orders are varied.

In these Terms and Conditions, a reference to Chillout is to the organisation Chillout Daylesford Inc, ABN 77 254 362 737. A reference to the Venue is to the premises and/or venue to which a ticket relates.

Please also refer to Chillout’s supplementary COVID-19 Special Terms at the end of this document.

The following conditions are for sale and attendance:

1. ChillOut reserves the right to withdraw, reschedule or substitute artists and may vary advertised programs, prices and venues.

2. There are NO REFUNDS on any ticket except as required by law or ChillOut’s COVID-19 Special Terms.

3. The right of admission is reserved by the box office staff at the Venue.

4. Admittance to customers bearing tickets purchased online at a discount price (such as student, pensioner and concession) require proof of relevant ID that will need to be presented to box office staff at the door before entry. Failure to produce appropriate ID may result in the patron being charged full price for their ticket.

5. No-one under 18 admitted to any licensed areas of any event. Proof of age required. Persons under 16 must be accompanied by a responsible adult.

6. Tickets will only be issued upon full payment.

7. Every patron must have a valid ticket.

8. ChillOut assumes no responsibility for any error, omission, interruption, deletion, defect, delay in transmission, or line failure and reserves the right to add, withdraw or substitute artists and to vary the program should the need arise.

9. No weapons, glass containers, specified prohibited items or lasers may be taken into any ChillOut event, unless otherwise advised by ChillOut.

10. No BYO alcohol may be taken into any ChillOut event, unless otherwise advised by ChillOut.

11. To the fullest extent permitted by law, ChillOut does not accept liability of any nature for the acts, omissions or default of those providing services in connection with the event or any liability for any injury, damage, loss, delay or additional expenses which are incurred at or in association with this event.

12. Where legislation implies any condition or warranty which cannot be excluded or modified, that condition or warranty will be deemed to be included in this agreement. However, ChillOut’s liability for any breach of such condition or warranty will be limited, at our option, to the resupply of the services or the cost of having the services supplied again.

13. In no event will ChillOut be liable for any indirect, consequential, exemplary or special damages.

14. You acknowledge that neither ChillOut nor the Venue will be responsible for any loss or damage to the property (including personal property such as bags, money or other personal items) brought to or purchased at the event by you or your invitees. You will be liable for any loss or damage caused at the event by you or your invitees.

15. ChillOut reserves the right to cancel or postpone the event for any reason, or to vary the mode of delivery of the event for any reason.

16. You must ensure that you and your invitees act in an orderly manner when attending the event. We may refuse entry or evict you or any of your invitees if they are behaving in a disorderly, offensive or inappropriate manner.

By clicking the “Purchase” button, you are agreeing to the above terms and conditions of sale, including the refund and exchanges sections. All orders are subject to credit card approval and billing address verification.

Keep your ticket in a safe place and safeguard it as you would money or regular tickets. Unauthorised duplication or sale of this ticket may prevent your admittance to the event.

The unique bar code on this ticket can only be used once. Multiple copies of this ticket will not allow multiple entries to the event.

In the event that duplicate copies appear, the Venue or promoter reserves the right to refuse entry to ALL ticket holders.

The ticket is a Tax Invoice. The total price of this ticket includes GST.

COVID-19 Special Terms

Chillout has adopted some special Terms and Conditions in light of the coronavirus (COVID-19) pandemic. These special terms are informed by a safety-first approach so that events are COVID Safe for all workers and audiences and mitigate risks of community transmission to the general public.

These special terms are set out below and operate to supplement the Terms and Conditions. If there is any inconsistency between the special terms and the other Terms and Conditions, the special terms apply to the extent of the inconsistency. All other Terms and Conditions continue in full force and effect.

Please note: ChillOut is obliged to enforce the Victorian Government’s COVID-19 Safety protocols and directions that are current at the time of the event. Such protocols/directions may differ from those in force at the time of ticket purchase.

A. Chillout has changed its procedures for Venue collection for the time being. If at the time of purchase you select to collect your tickets from the Venue, physical tickets may not be issued for selected events. Instead of being issued with physical tickets, your name will be checked at the door against the details provided by you at the time of booking.

In order for you and your booking party to be admitted, you may be required to present the order confirmation number, photo identification and valid proof of any concession entitlement/s.

B. You acknowledge that due to physical distancing requirements, tickets to events may be sold as unallocated at the time of purchase. Chillout reserves the right at its sole discretion to allocate seats for you and the members of your booking party prior to or at the time you attend the applicable event.

C. In accordance with health guidelines, Chillout may require payment transactions to be completed using contactless payment. Cash payments may not be accepted for some or all transactions.

D. Chillout supports the Federal Government’s recommendation regarding the use of the COVID Safe App. We encourage you and your booking party to download and use the App when attending our venues.

When you must stay at home

E. You must stay at home and must not attend the Venue or the event if you:

a. are required to self-isolate or quarantine (and the event falls within the isolation/quarantine period) due to:

i. being a confirmed case of COVID-19; or

ii. having close contact with a confirmed case of COVID-19; or

iii. living in or having been in a high-risk area within Australia; or

iv. having returned from overseas.

b. have COVID-19 symptoms, have been tested for COVID-19 and are awaiting test results (and the event falls within the period of awaiting test results). The symptoms of COVID-19 include: fever, chills or sweats, cough, sore throat, shortness of breath, runny nose or loss of sense of smell.

F. You must communicate these requirements to members of your booking party which apply to them as well.

Ticket Exchange or Refund in relation to COVID-19

G. We are offering additional flexibility through our refund policy at this time, having regard to the uncertainties posed by COVID-19 and to encourage you and the members of your booking party to comply with the stay-at-home requirements in Clause E.

H. You will be entitled to a refund or exchange if you or a member of your booking party falls into any of these categories:

a. You or they are required to self-isolate or quarantine (and the event falls within the isolation/quarantine period) due to:

i. being a confirmed case of COVID-19; or

ii. having close contact with a confirmed case of COVID-19; or

iii. living in or having been in a high-risk area within Australia; or

iv. having returned from overseas.

b. You are unable to travel to attend the event due to border restrictions.

c. You or they have COVID-19 symptoms, have been tested for COVID-19 and are awaiting test results (and the event falls within the period of awaiting test results). The symptoms of COVID-19 include: fever, chills or sweats, cough, sore throat, shortness of breath, runny nose or loss of sense of smell.

You must contact us as soon as possible if you or a member of your booking party falls into any of these categories.

COVID-19 safety when you attend our Venues and events

I. When you attend our Venues and events, you and each member of your booking party must comply with any COVID-19 safety protocols or requirements notified to you by Chillout (including by way of signage at the Venue or by way of line markings on the floor). This includes complying with:

a. Hand hygiene requirements and the requirement to wear a face mask;

b. Physical distancing requirements (including physical spacing requirements while queuing);

c. Person limits for particular spaces and areas; or

d. Person density requirements.

You acknowledge that anyone not adhering to these requirements may be in breach of directions issued by the Chief Health Officer for which penalties may apply.

The most up to date COVID-19 Safety protocols can be found on the Victorian Government’s website – https://www.dhhs.vic.gov.au/coronavirus. Please check these on the day before arriving at the Venue.

J. You acknowledge that Chillout may be required to collect contact tracing information from you and each member of your booking party when you and they attend the Venue. This includes the first and last name and phone number of each person who attends the Venue including children and babies. You must communicate this requirement to each member of your booking party before they attend the Venue.

K. You agree to provide us with any information we are required to collect for contact tracing purposes. The purpose of collecting this information is to assist any contact tracing in the event of an outbreak or potential exposure to someone with COVID-19 at the Venue. You acknowledge that we may disclose contact tracing information to health authorities or as otherwise required or authorised by law.

You acknowledge that we may retain the information for 28 days (or such longer period as required by law), after which time it will be deleted or destroyed. While we hold the information, we will take all reasonable steps to keep your contact tracing information secure and free from unauthorised access or use.

L. Without limitation, you and your booking party may be refused entry or required to leave the Venue or event if you or they:

a. refuse to comply with any COVID-19 safety protocols or requirements notified to you by Chillout;

b. refuse to comply with any reasonable health and safety directions given by Venue staff;

c. refuse to provide contact tracing information to Chillout on request;

d. are exhibiting symptoms of COVID-19, as notified to or as assessed by Venue staff. These include: fever, chills or sweats, cough, sore throat, shortness of breath, runny nose or loss of sense of smell;

e. have been tested for COVID-19 and are awaiting test results; or

f. are required to be in self-isolation/quarantine due to:

i. being a confirmed case of COVID-19; or

ii. having close contact with a confirmed case of COVID-19; or

iii. living in or having been in a high-risk area within Australia; or

iv. having returned from overseas.

In these circumstances, Tickets will not be exchanged or refunded unless required by law (including the Australian Consumer Law).
